Increase in Trademark Registration & Renewal Fees In Singapore

The Intellectual Property Office of Singapore (IPOS) has announced that they will be implementing fee updates that will come into effect on 29 April 2022.

Currently, to apply for trademark registration, the application is split into two categories:

a) Applications with descriptions of goods and services that are fully pre-approved

b) Applications with descriptions of goods and services that are not fully pre-approved

Trademark Renewal & Restoration

Trademark renewal (on or before expiry date)

A registered trademark last for ten years from the date of application. Trademark renewal in Singapore can only be made six months before the trademark’s expiry date, and it is processed instantly.

Late renewal of trademark

If a registered trademark has not been renewed by its expiry date, the trademark’s status will then be updated as “Expired (Late Renewal Possible)”. Late renewals of such trademarks can still be made up to six months from the expiry date.

Restoration of trademark

If renewal of a trademark is not filed within six months from the trademark’s expiry date, the status of the trademark will be updated to “Removed (Restoration Possible)”. This status will remain for another six months.

A registered trademark that is not renewed or restored twelve months after expiry will removed and cannot be restored.

Conclusion

Having a trademark registration is essential for any business. It gives the owner exclusive rights to the trademark. A trademark registration is valid for ten years and can be renewed indefinitely every ten years at little cost.

The increase in registration and renewal fees will take effect on 29 April 2022. Trademark owners may wish to review your trademark portfolios and ensure that any trademarks with expiry dates upcoming soon are renewed in time. You can take advantage of the current IPOS fee structure before the fee hike takes force.
